Please read these Terms and Conditions ("Terms") carefully before participating in the Big Bear Charity Raffle ("Raffle") conducted by the Alive and Well Foundation, a 501(c)(3) non-profit organization ("Organizer"). The Raffle is intended to raise funds for charitable purposes, with the proceeds being used to support the Organizer's mission. By purchasing a raffle ticket and participating in the Raffle, you agree to be bound by these Terms.

Eligibility

1.1 The Raffle is open to legal residents of the United States who are 25 years of age or older at the time of entry. Employees, officers, directors, and their immediate family members (spouse, parents, children, and siblings) of the Organizer, affiliated companies, and advertising/promotion agencies are not eligible to participate.

Raffle Entry

2.1 The Raffle will begin on October 23, 2023, and end on December 31, 2023. To enter the Raffle, you must purchase a raffle ticket online for $50 each. Multiple ticket purchases are permitted to increase your chances of winning. No discounts or promotions are available for purchasing multiple tickets. Any discounts made will be at the discretion of the Organizer. "Free Vacation" offered for the purchase of any products is defined as purchaser receiving one (1) free raffle ticket.

Prize

3.1 The prize awarded in this Raffle includes a vacation package to Big Bear, California for four (4) consecutive days in January, 2024, for a family of five, with a cap of $5,000 on all expenses, including any expenses accrued by the Organizer in preparation of the itinerary. The prize is non-transferable and cannot be substituted except at the Organizer's sole discretion. The winner is responsible for all taxes, fees, and other expenses not explicitly included in the prize.

Odds of Winning

4.1 The odds of winning the prize depend on the total number of eligible entries received.

Winner Selection and Notification

5.1 The winner will be selected in a random drawing from all eligible entries received. The winner will be notified by email or phone and all participants will be required to sign and return an affidavit of eligibility, a liability release, and a publicity release (where permitted by law) within five (5) business days. Failure to comply with these requirements, or if the winner cannot be contacted or is otherwise ineligible, will result in an alternate winner being selected.

Unclaimed Prize

6.1 If the winner fails to claim the prize within the specified time frame or is unable to meet any requirements associated with the prize, the prize may be forfeited, donated, or awarded to an alternate winner at the Organizer's discretion.

Responsibilities of the Winner

7.1 The winner is responsible for obtaining all necessary travel documents, such as passports or visas, and any other requirements associated with the prize. The winner must also coordinate travel logistics within the specified time frame.

Insurance and Liability

8.1 The vacation home accommodation provided as part of the prize will be hosted by Airbnb. The insurance coverage for the vacation home will be conducted via Airbnb's policies, and the winner will be required to agree to Airbnb's terms and conditions independently.

8.2 All referred activities included in the prize package will hold their own insurance policies. The winner will be required to independently agree to the terms and conditions of each activity provider, and such agreements will not be associated with the campaign prize.

8.3 The Organizer shall not be responsible or liable for any injury, loss, or damage of any kind sustained by any person while participating in the Raffle, including but not limited to any injury, loss, or damage arising from or in connection with the acceptance, possession, or use of the prize or any portion thereof.

No Refunds

9.1 All raffle ticket sales are final, and no refunds will be granted under any circumstances. By purchasing a raffle ticket, you acknowledge and accept this condition.

Disqualification

10.1 Participants may be disqualified from the Raffle for providing false information, tampering with the Raffle process, or violating these Terms and Conditions. The Organizer reserves the right to disqualify any participant at its sole discretion.

Marketing and Promotional Material

11.1 By accepting the prize, the winner grants the Organizer permission to use their name, image, and likeness in marketing and promotional materials related to the Raffle without further compensation, unless prohibited by law.

Indemnification and Limitation of Liability

12.1 By participating in the Raffle, you agree to indemnify, defend, and hold harmless the Organizer, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your participation in the Raffle or your acceptance, possession, or use of the prize.

12.2 In no event will the Organizer, its affiliates, or their respective officers, directors, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, arising from your participation in the Raffle or the acceptance, possession, or use of the prize.

General Conditions

13.1 By participating in the Raffle, you agree to release and hold harmless the Organizer, affiliated companies, and advertising/promotion agencies, and each of their respective officers, directors, employees, and agents, from any and all liability, loss, harm, damage, cost, or expense arising out of your participation in the Raffle, including but not limited to the acceptance, use, or misuse of the prize.

Governing Law and Jurisdiction

14.1 This Raffle is governed by the laws of the United States and the State of Georgia, without regard to conflicts of law principles. By participating in the Raffle, you agree to submit to the exclusive jurisdiction of the courts located within the State of Georgia in any dispute arising out of or relating to the Raffle.

Tax Implications

15.1 As a 501(c)(3) non-profit organization, the Alive and Well Foundation is not responsible for any federal or state income tax that may be due on the prize, nor for any penalties or interest that may be incurred as a result of the winner's failure to comply with applicable tax laws and regulations. The winner is solely responsible for determining the tax implications of winning the prize and complying with all applicable tax laws and regulations.

15.2 The Alive and Well Foundation will provide the winner with a tax form as required by law, reporting the value of the prize awarded in this Raffle. The winner is solely responsible for reporting the prize on his or her tax return and paying any taxes due on the prize. We recommend that the winner consults with a tax professional to determine the specific tax implications of winning this prize. The winner is responsible for complying with all applicable tax laws and regulations and agrees to indemnify and hold harmless the Alive and Well Foundation from any and all claims, liabilities, damages, or expenses arising out of or in connection with any failure to comply with applicable tax laws and regulations.

Privacy

16.1 All personal information collected from Raffle participants will be used solely for the purpose of administering the Raffle and will not be shared with third parties except as required by law or to comply with legal process.
